Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Loopstates ("Funnel Engine", "we", "us", or "our") governing your access to and use of our platform located at https://funnelengine.site, associated software, AI funnel creation tools, and APIs (collectively, the "Services").

If you do not agree with any part of these Terms, you are prohibited from accessing or using the platform.

2. Description of Platform

Funnel Engine provides an artificial-intelligence powered marketing funnel builder, drag-and-drop visual editor, smart checkout gateway integrations, automated follow-up workflows, and real-time analytics designed to help businesses create and scale revenue funnels.

3. Account Registration & Security

• Eligibility: You must be at least 18 years old or the legal age of majority in your jurisdiction to create an account.
• Account Integrity: You agree to provide accurate, complete, and updated registration details. You are responsible for maintaining the confidentiality of your credentials and all actions performed under your account.
• Notice of Unauthorized Use: You must notify Funnel Engine immediately upon discovering any security breach or unauthorized account access.

4. Subscriptions, Fees & Billing

A. Billing & Payment Processing

Subscription plans are billed on a recurring basis (monthly or annually) as specified during signup. All payments are processed securely via Stripe. By subscribing, you authorize Funnel Engine to charge your designated payment method for subscription fees, applicable taxes, and add-on usage.

B. Cancellations & Refunds

You may cancel your subscription at any time through your account portal. Cancellations take effect at the conclusion of your current billing cycle. Unless required by mandatory consumer protection laws, subscription payments are non-refundable.

5. Acceptable Use & Conduct

You agree to use Funnel Engine strictly for lawful business purposes. You agree NOT to:

• Create sales funnels, landing pages, or checkout flows that promote deceptive schemes, illegal products, malware, phishing, or hate speech.
• Send unsolicited bulk emails (spam) or violate anti-spam legislation (e.g., CAN-SPAM, GDPR).
• Attempt to reverse-engineer, decompile, crawl, or exploit the Funnel Engine codebase or AI prompt algorithms.
• Overburden or disrupt our cloud server infrastructure or bypass system rate limits.

6. Intellectual Property & Data Ownership

A. Your Content Ownership

You retain 100% full data ownership of all text copy, branding assets, customer leads, and business telemetry uploaded or configured inside your funnels. Funnel Engine claims no ownership over user-generated content.

B. Funnel Engine IP

All platform infrastructure, software code, visual editor UI, AI models, templates, trademarks, and documentation remain the exclusive intellectual property of Loopstates.

7. Service Availability & Warranties

We strive to maintain maximum uptime and platform reliability. However, the Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free funnel operation during scheduled maintenance windows or unforeseen network carrier disruptions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Loopstates and its officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill arising out of your use of or inability to use the platform.

9. Termination & Account Suspension

We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms, engage in fraud, or misuse the system. Upon termination, your right to access funnels and hosted assets will cease immediately.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising out of these Terms shall be resolved through binding arbitration or appropriate courts of competent jurisdiction.

11. Modifications & Contact

We reserve the right to update or modify these Terms at any time. We will notify users of material changes via email or platform notice. Continued use of the platform after updates constitutes acceptance of the modified Terms.
